TERMS
These terms are a binding agreement between you and Dave Radoicic, the independent developer of OraTune ("the Developer," "we," "us," or "our"). They govern your use of the OraTune.app website (the "Site") and the OraTune desktop application (the "Software"). By downloading, installing, or using the Software, or by using the Site, you agree to these terms. If you do not agree, do not use the Software or the Site.
License
OraTune is provided free of charge. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software for your own personal or internal business purposes. You may not sell, rent, sublicense, or redistribute the Software, and you may not modify, decompile, or reverse-engineer it, except to the extent applicable law expressly permits despite this restriction. We retain all rights, title, and interest in the Software and the Site that are not expressly granted to you.
Your data and AI providers
The Software runs locally on your machine. The SQL, execution plans, reports, and dump files you analyze stay on your machine and are not sent to us or to the Site. If you enable an AI provider inside the Software (such as Claude, OpenAI, Azure OpenAI, or GitHub Copilot), the content you submit for analysis is sent to that provider's API and handled under that provider's own terms and privacy policy. You are responsible for the API keys you configure and for ensuring you are permitted to send that content to the provider. See the Privacy page for how the Site handles information.
Oracle and third-party components
OraTune is an independent tool and is not affiliated with, endorsed by, or sponsored by Oracle Corporation. Oracle and related marks are trademarks of Oracle Corporation, used here only to describe compatibility. The Software includes third-party open-source components, each licensed under its own terms.
No warranty
OraTune is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be accurate, uninterrupted, or error-free, or that its findings are complete or correct. You use OraTune, and act on its output, at your own risk.
Limitation of liability
To the fullest extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of the Software or the Site. Because OraTune is provided free of charge, the Developer's total liability for any claim relating to the Software or the Site will not exceed one hundred U.S. dollars (US $100).
Governing law
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. Any dispute arising under them is subject to the exclusive jurisdiction of the state and federal courts located in that state.
